What is Liability Insurance?
Liability insurance is designed to cover businesses against the risk of liabilities imposed by lawsuits and claims. Such liabilities can involve personal injury, damage to property or financial losses caused by negligence, for example.
Liabilities can arise from duties imposed by law or liabilities arising from contract or tort.
Public Liability Insurance
Having public liability insurance is an important consideration for any business that interacts with the public or other businesses. The principal coverages are: personal injury and property damage.
Professional Indemnity Insurance
Professional indemnity insurance is also known as professional liability insurance or errors and omissions insurance. It is designed to cover any negligent acts or omissions (for example, incorrect advice) that may result in a loss to a client. Even in cases where there is no evidence of negligence, a claim may be pursued against the insured company which may then result in a lawsuit. Professional indemnity policies provide cover for defence and for defence costs.
Professional indemnity insurance is not relevant to all businesses. However, if one is in the business of selling your skills or knowledge then such protection is advisable. In the case of some professions, PI insurance is obligatory. Hence, accountants, solicitors, architects, financial advisers, for example, are all required to secure such cover.
Such coverages are necessary in the marine and transportation field where an action may be brought against a transport intermediary in cases, for example, where loss or damage may have occurred to goods in transit or where a freight forwarder has released goods to a third party without the tender of the original bill of lading, thus resulting in a financial loss to the shipper.
An insurance broker may be at the receiving end of a claim or lawsuit in cases where the insurance broker gave incorrect advice on a policy, failed to secure the coverage required by its client or failed to explain gaps in cover between an expiring policy and a renewal policy.
Directors and Officers Insurance (D and O Insurance)
Directors, partners or officers of a company have additional and specific responsibilities to their employees, members of the public, investors and regulators. D and O insurance is designed to protect the personal assets of officers and directors against claims and lawsuits arising from their professional capacity. Claims may include breach of duty, negligence, defamation and pollution.
Environmental Liability and Pollution Insurance
A public liability policy may be inadequate for protection against environmental and pollution liabilities.
Environmental coverages may offer:
